Terms of Use: American Homebrewers Association® Auto Renew Membership

Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and the American Homebrewers Association (“Company”, “we”, “us”, or “our”), a division of the Brewers Association, concerning your membership, payment of membership, access to and use of HomebrewersAssociation.org (“the Site”).

You agree that by selecting an American Homebrewers Association (AHA) Auto Renew Membership, you have read, understood and agree to be bound by these Terms of Use, including our Privacy Policy posted on the Site or at BrewersAssociation.org/privacy-policy.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. From time to time, we may modify or change this policy. We will update the date of this policy at such time, so please check back from time to review any changes or updates we may make.

AHA Auto Renew Membership

You authorize the American Homebrewers Association to charge monthly or annual payments on a recurring basis to your preferred payment method without requiring your prior approval for each recurring monthly or annual charge. 

Your AHA Auto Renew Membership will continue and automatically renew until terminated. You must cancel your membership before it renews to avoid billing of membership fees for the next billing cycle to your payment method (see “Cancellation” below).

We reserve the right to adjust pricing for membership at any time as we may determine in our sole and absolute discretion. Any price changes or material changes to your membership will take effect following notice to you.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the Site. All payments shall be in U.S. dollars.

If we are not able to charge any payment to a payment method on file in your account, we reserve the right to pursue any remedy that is available to us, including the right to suspend or terminate your American Homebrewers Association membership, which will block your ability to access to the Site and American Homebrewers Association content and services. You agree that we have no liability related to the exercise of these remedies.

User Representations

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you recognize that some of our events and programs may require you to be current on your membership dues in order to participate (such as ticket pre-sales or early event registrations), (5) you are legally allowed to use the Site; (6) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (7) you will not use the Site for any illegal or unauthorized purpose; and (8) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). 

Without limiting any other provision of these Terms of Use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms of Use or of any applicable law or regulation. We may terminate your use or participation in the Site or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

As an AHA member, your breach of any of the representations above may constitute a violation of the AHA Non-Discrimination Policy, found at HomebrewersAssociation.org/non-discrimination-policy. You also agree to be bound by the Brewers Association Marketing and Advertising Code, which are incorporated into these Terms of Use and found on BrewersAssociation.org/brewers-association-advertising-marketing-code.

Cancellation

The initial membership purchase, and all monthly or annual installment payments, are non-refundable. 

Members can cancel membership at any time to prevent auto renew payments by signing into their user profile, selecting “Manage/Renew Membership” and then selecting “Manage” on the current term. From there, the user can select “Cancel” in the subscription section. Upon cancellation, automatic payments will cease, and membership will continue until your current expiration date.

In accordance with your membership expiration date, you accept immediate forfeiture of access to any and all American Homebrewers Association properties and resources, effective immediately, that would otherwise be deemed as limited to an active member. Such forfeiture may include cancellation of any registrations for future events that require active membership to participate. Limitations of Liability

Information on the Site is for informational purposes only, and shall not be viewed as legal, accounting, or other professional advice, nor as substitutes for such advice. You shall use information found on the Site at your own risk and you recognize and agree that we shall incur no liability of any kind arising from or relating to your use of or reliance on information provided on the Site.

Privacy

We care about data privacy and security. By purchasing any AHA membership, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use. Further, we do not knowingly accept, request, or solicit information from anyone under the age of 21 or knowingly market to anyone under the age of 21.
